First and foremost, thanks to all the Artists, DJ and Labels who support BCD
and fiercely support us against the ridiculous claims made in an article on
the ya heard blog posted at SOHH.com

Although the website does state that this is the buzz, on rumors, gossip and
the unconfirmed, many people are speculating that where there”s smoke there
must be fire, and even our long term associates, actually asked if we resorted
to reporting Drama to the RIAA as payback for his dealings with our Company.

One particular DJ / client was so shell, shocked by the whole incident, it actually
took him 24 hrs. before, he came out of hiding, and thankfully, the people he
chose to place his trust in, were his friends and family at BCD. As we have
filed lawsuits against various entities, I am not at liberty to discuss material
facts of slander, libel, tortuous interference however, I would like to address
certain issues, pertaining to the aforementioned article.

BCD Music Group, nor any of it”s employees had any such knowledge of any wrong
doings by DJ Drama or Don Cannon. The business
conducted between Aphilliates and BCD was done on a purely professional basis
and BCD had no intimate knowledge of the Aphilliates business dealings with
others or the day to day activities involving Aphilliates, its owners or employees.

We received the news on Tuesday evening, from a member of this board and were
in as much shock as I believe the whole DJ / mixtape community were. Initially,
we thought the majors had decided to take direct action against the DJs although
it made no sense to us whatsoever. Over the last few days a different scenario
has been evolving and although I believe that as a company we have more than
a vague idea as to what is truly happening, I do not want us to be instrumental
in pointing fingers towards others without having concrete evidence to support
such claims, as that would make us NO better than the close source to SOHH who
purposefully and willfully make accusations against our Company knowing full
well that they were a complete and utter fabrication.

On Tuesday night, I was absolutely outraged, after learning about the problems
DJ Drama and Don Cannon were facing, for
supposedly pressing their own mixtapes. It is my belief that if the news indeed
reported correctly that Drama and Cannon were arrested for distributing mixtapes,
then all DJ”s not just these high profile celebrities, would all be in severe
risk of losing their jobs (those that work on radio stations) especially.

Therefore, on Tuesday evening, I personally called a bail bondsman in Atlanta
to try and facilitate the release of both Tyree C. Simmons and Donald Cannon.
Unfortunately, I was unable to post bail as no bail had been set and no time
had been appointed at that time for them to stand in front of a Judge. So for
any third party to state that BCD had some vendetta against DJ Drama is very
much mistaken. I do not deny that we have some business issues with Aphilliates
and others, that we have chosen to settle within the judicial system, however
that does not equate to BCD or any of it”s associates wishing any harm to Mr.
Simmons, Mr. Cannon or their family, friends, employees or associates.

The SOHH article states the source remained tight lipped. The source whomever
it may be, made so many statements, that were absolute lies, it should be obvious
to any person with above average intelligence that the person making the statements
wanted to cause BCD Music Group financial harm and irreparable damage within
the hip-hop community. BCD had nothing to gain either personally or financially
by seeking to as the article states, "snitch and pull strings, to get Drama
and Cannon found out".

Since the arrest of Drama, many buyers are refusing to buy mixtapes, even legitimate,
licensed mixtapes, as they do not want the negative publicity that is currently
surrounding this issue. Therefore, we are seeing a lot of our product being
pulled from the shelves and buyers refusing to buy any of our upcoming artists,
or DJ”s. Many of these people rely on the monies they receive from us to enable
them to attend events and promote, so that they too may one day enjoy the luxuries
that some of our artists have gone on to enjoy after having independent sales
success with BCD.

So for any person to believe that BCD had anything to do with the arrest of
DJ Drama, is both unreasonable and illogical. Another point I would like to
draw your attention to with regards to the SOHH article is that, whomever wrote
the story is obviously not a journalist and would not even make it as an intern
within a credible news association. Journalists know that it is important to
research your facts and only print what can be substantiated. A disclaimer stating
rumor, gossip and the unconfirmed does not protect SOHH or make them immune
from being held accountable in a court of law for their actions or those of
their employees, contractors etc., for libel, slander and defamation of character
which carries severe financial penalties if proven.

With regards to the story in the NY Times, as you will note they have represented
the facts without implicating any names. Their story states that reports were
made to local law enforcement on behalf of an array of artists with the issuance
of Cease and Desist Letters from their lawyers. I am not sure as to how many
artists sent out such letters, however I can state that we did receive a Cease
and Desist Letter from one such artist”s lawyer, which named DJ”s titles and
accused the DJ”s of being bootleggers who did not have the rights, to sell us
the titles. All the DJ”s accused had close relationships with the said artist.
The letter also stated that if we did not cease and desist immediately that
the RIAA and local law enforcement would be notified.

Finally, at the end of the day the evidence will come out in court, although
many times I have known guilty parties to settle prior to trial so that the
truth does not get out and damage the artist”s celebrity status. With regards
to DJ Drama and Don Cannon, we wish them well with their current legal difficulties
and hope that this matter helps DJ”s and mixtapes rather than hinders them.
Out of every difficult situation something good will come out of it, even if
you can”t see it initially. Setting aside contract issues we may have with the
Aphilliates, we will support them, and vigorously defend their rights as DJs.
As a Company we keep documentation on everything and it is ironic that we are
the people that are probably going to be able to vindicate DJ Drama, Don Cannon
and the Aphilliates collectively, should this case go to court.
