Defense attorneys for William Balfour, the man accused of killing three of Jennifer Hudson’s relatives, would like to question the singer/actress, reports The Chicago Sun Times.

Via Essence: Amy Thompson, Balfour’s attorney wants to have a “face-to-face” meeting with the Academy Award winner regarding a possible text message exchange with Hudson’s mother, Darnell Donerson, before her death.

Thompson and prosecutors debate whether there was “enough probable cause” for Balfour’s arrest on October 24, 2008, which was the day of the murders.

Balfour’s attorney argues he did nothing illegal at the time of arrest, thus they’re asking the arrest be dismissed from the case. However, the Assistant State’s Attorney is asking the judge to review the police testimonies detailing Balfour’s alleged constant threats to kill Julia Hudson in the days before the murders.

Balfour is accused of murdering Hudson’s mother, brother, and her nephew. The trial is set for April
