Longtime incarcerated rapper Shyne has finally received a release date from prison, October 6, 2009.

While Shyne’s imminent release has been been rumored about for years, this date is actually confirmed by the parole board, though the former Bad Boy rapper must still attend a hearing today, to receive the parameters of his parole.

“The judge will decide whether to give him the maximum parole, which is five years, or the minimum parole, which is two-and-a-half years,” Shyne’s attorney, Oscar Michelen, explained. “Shyne will automatically have to do at least a year-and-a-half, which is how much of [the] 10 year [sentence remains]… [Shyne] still owes the balance to the 10. But, [the district attorney] also [has] been looking to add to that [time] as well…”

While the math on his time-served is confusing, that’s just the tip of the iceberg for Shyne. “The same D.A. [from 2001] is on the case,” continued his attorney, “that’s Matt Bogdanos. He’s in Iraq… And, it’s being handled by the D.A. who’s in charge of all post-release supervision. When they enacted mandatory sentencing, determinate sentencing, they said that you also had to have mandatory parole. Most judges just assumed that parole would be added automatically. They didn’t realize that they had to actually sentence the person to it. So now a new law was passed that allows the Correction Department to address that by asking the judge to re-sentence the inmate…”

In the meantime, Shyne has been moved from Woodbourne Correctional Facility in Sullivan County, New York to Rikers Island, in preparation for his appearance. While his release date is officially set, he will learn today whether he will be allowed to return to his recording career, and what parameters will be set on his activities; if he is sentenced to a 5-year parole tearm, he will not be allowed to tour.

“Enough is enough. Five years [post release supervision] is overly harsh and unnecessary,'” Michelen stated. “He’d need permission for everything…and so that would really be a problem and be very restrictive on him.”
